General informations

Tahiti Air Charter is a flying company authorized by the Civil Aviation with the Air Carrier Certificate n° FR.AOC.0123
The company Tahiti Air Charter is registered under n° Tahiti – A50960 SARL TAHITI AIR CHARTER,  RC 12 273 B.

Object

The following general conditions of sales and transportation establish the terms and conditions required by the company to provide to the customers the flying services (here named the “Services”) in compliance with the Convention for the unification of the rules relative to the international aerial transport, signed at Warsaw on October, 12th 1929 as amended by the protocol of Hague on September 28th, 1955.

The general conditions are effective and subject to the below conditions, as soon as a transportation service is purchased.

Rates

All the rates indicated or mentioned on the website www.tahiti-air-charter.com are stated in Euros or in US Dollars, all taxes included.
For “scenic” flights and day tours, all the rates will be stated per person, for one adult passenger of 120kg maximum (264 lbs).
For the babies, children (under 12 years old), and passengers over 120 kg (264 lbs), some special rates are available upon request.

Reservation

Any reservation must be done through :

As soon as a reservation is registered, Tahiti Air Charter  agrees to send to the customer a confirmation upon availability, indicating the total amount to pay and a credit card authorization form.

From the moment Tahiti Air Charter receives the total payment, the customer will receive a boarding pass with a reservation number. The customer will have to present his boarding pass to the company before boarding to start a tour.

Payment  

Any payment of any service must be done by credit card over our securised payment system, by bank transfer to our bank account (Banque de Tahiti), or by cheque on site at our headquarters in Papeete.

Modifications

– Scenic flights and day tours

  • From Tahiti Air Charter

Tahiti Air Charter agrees to ensure in the best way possible the service booked by the customer. In case of any schedule, duration or trajectory modification, for any program, caused by the weather forecast, technical reasons or in case of force majeure, no refund will be made. Should there be any problem known in advance of the flight, resulting in itinerary / program changes, Tahiti Air Charter will advise their customers accordingly.

  • From the customer

For any modification made by the customer for the booking of a “scenic” flight or a day tour, the following penalties will be applied :

– Modification more than 3 days before the service : no modification fee
– Modification between 3 days and 24 hours before the service: 25% modification fee charged
– Modification less than 24 hours before the service: 50% modification fee charged

For private charters, different conditions will be applied and mentioned on your quotation.

– Private charter flights

  • From Tahiti Air Charter

Tahiti Air Charter agrees to ensure in the best way possible the service booked by the customer. In case of any schedule, duration or trajectory modification, for any program, caused by the weather forecast, technical reasons or in case of force majeure, no refund will be made. Should there be any problem known in advance of the flight, resulting in itinerary / program changes, Tahiti Air Charter will advise their customers accordingly.

  • From the customer

– Modification more than 7 days before the service : 25% modification fee
– Modification between 3 days and 48 hours before the service : 50% modification fee charged
– Modification less than 48 hours before the service : 100% modification fee charged

Cancellation policy

– Scenic flights and day tours

  • From Tahiti Air Charter

Tahiti Air Charter agrees to ensure in the best way possible the service booked by the customer. Nevertheless, in case of a flight cancellation engendered by the weather forecast or technical reasons, all the services booked will be refunded without any other compensation.  

  • From the customer

For any cancellation made by the customer for the booking of a “scenic” flight or a day tour, the following penalties will be applied :

– Cancellation more than 3 days before the service: no cancellation fees
– Cancellation between 3 days and 24 hours before the service: 50% of fees charged
– Cancellation less than 24 hours before the service: 100% fee charged

The customer will have to present himself at the place and the time indicated on the boarding pass. Please note that no refund will be made in case of no show or if the tour has started.

– Private charter flights

  • From Tahiti Air Charter

Tahiti Air Charter agrees to ensure in the best way possible the service booked by the customer. In case of any flight cancellation, engendered by the weather forecast or technical reasons, all the services booked will be refund without another compensation.

  • From the customer

For any cancellation made by the customer for the booking of a private charter flight the following penalties will be applied:

– Cancellation more than 30 days before the service: 25% of fees charged
– Cancellation between 30 and 7 days before the service: 50% of fees charged
– Cancellation less than 7 days before the service: 100% fee charged

Please note that no refund will be made in case of no show.

Boarding

Upon boarding time, the customer must present himself to the company representative with :

– His nominative boarding pass
– His ID card with a photo

Tahiti Air Charter reserves the right to refuse a passenger who does not present his boarding pass or ID card on board, as well as a passenger that could endanger the security and the organisation of the planes during the flight.  

Once boarding on Tahiti Air Charter, the company reserves the right to disembark any passenger or customer with a behaviour that could endanger the crew, the plane or the other customers on board and their personal effects.

Customers with reduced mobility

As Tahiti Air Charter aircrafts are not authorized to accommodate passengers with reduced mobility. For the safety and comfort of all our customers, we ask them to provide us with this type of information when booking a service.  

Pregnancy

Under eight months of pregnancy (33 weeks), pregnant women are allowed on board.
For security and comfort reasons, women beyond 33 weeks of pregnancy will not be able to board on the plane.

Children policy

Minor passengers (under 18 years old) will not be allowed to board on the plane except if they are being accompanied by a legal representative.
If they have a written authorization from a legal representative, they will also be allowed on board.

Luggage

As the space on board is limited, some weight restrictions may occur on our flights :

  • Scenic flight : 5 Kg (11 pds)  per passenger
    – Day tour : 10 Kg (22 pds) per passenger

For private charters, different conditions will be applied and mentioned on your quotation.

Prohibited and restricted items on board

In order to ensure the crew and the passengers’ safety, the transportation of any items or liquids whether these are stored in the cabin, the baggage hold or the floats, is strictly regulated. In you have any doubt, please feel free to contact us in order to get the complete and detailed list of the prohibited and controlled items on board.

  • EXPLOSIVE OR INCENDIARY SUBSTANCES AND DEVICES,
  • SUBSTANCES WITH NEUTRALIZING, FLAMMABLE, CORROSIVE EFFECT NOT ALLOWED IN CABIN

PROHIBITED IN CABIN

  • Firearms, whether or not subject to authorisation and  firearms imitation
  • Devices designed to knock out or immobilize
  • Sharp and cutting objects
  • Work tools that can be used to injure
  • Items that can be used to strike
  • Liquids, aerosols or gels >100 ml unless purchased duty free in sealed bags

REGULATED IN CABIN

  • Liquid or essential products
  • External or contained lithium cells and batteries

PROHIBITED IN FLOATS AND HOLD COMPARTMENTS

  • Electronic cigarette
  • Lighter and/or lighter refill
  • Mercury barometer
  • External lithium cells and batteries (e.g. spare cells and batteries)

  • Lithium cells and batteries contained in an appliance/equipment

Insurance and responsibility


-Passengers

For all the intern flights operated in French Polynesia, the air carrier responsibility, submitted to the measures of the article L. 6421-4, is subject to the Warsaw Convention conditions, settled on October 12th, 1929 and modified by the Hague Protocol on September 28th, 1955.  

The limit of Tahiti Air Charter liability for damages caused to the passengers is set at €114,336 per person. And the effective period for the customer complaint is of two years from the arrival at destination or the day the aircraft should have arrived or the day the transport stopped.

-Luggage

Tahiti Air Charter shall not be liable for any damages caused in whole or in part to any luggage whether as a result of carelessness, prejudicial act or omission from the customer, than a flaw of the luggage itselves.

Subject to the above conditions, the liability of Tahiti Air Charter in case of damages, delay or loss of one luggage or more than one, shall be limited to 17 D.T.S, agreed 20€/Kg (20$/Kg)

Any protest regarding the luggage must be made with a recorded letter within a period of 7 days to be effective. Once the delay is passed, the protest will not be considered.

The liability of Tahiti Air Charter will only be involved for the conditions and limits stated in this article, and this, regardless of the individuals protesting and regardless of the reason of their protest.

General sales conditions modification

Tahiti Air Charter reserves the right to modify the stated sales conditions according to the evolution of its services or the legislation in effect.

Protection of personal datas

In conformity with the Datas and Freedoms Protection Act passed on January 6th, 1978, you have the right to question, to have access to, to modify, to contest and to correct your private personal datas.

By concurring with the stated general sales conditions, you agreed to allow us to collect and to use your personal datas in order to draft this contract. Applicable legislation

Please note that only the French Legislation is applicable and will be apply as for :

– The Warsaw Convention of October 12th, 1929 as amended by the Hague Protocol of September 28th, 1955.

–  The laws of the Civil Aviation Code and the Transport Code applicable to French Polynesia

Any litigation arising from this contract shall be submitted to the Courts of Papeete, island of TAHITI, French Polynesia.
